ACCC Releases Guidance Publications for Franchising Code - Franchising Update - August 2010

On 1 July 2010 the Trade Practices (Industry Codes – Franchising) Amendment Regulations 2010 commenced, giving effect to the Franchising Code reforms. A summary of the amendments to the franchising code which took effect from 1 July 2010 were outlined in our June 2010 update, which you can view here.

On 3 June 2010, the Government released the Trade Practices (Industry Codes – Franchising) Amendment Regulations 2010 made under section 172 of the Trade Practices Act 1974 (Regulations). The Regulations give effect to the Government’s proposed reforms to the Franchising Code outlined in our March 2010 update, which you can view here.

On 3 March 2010, the Federal Government released an expert panel report commissioned by the Minister for Small Business, Independent Contractors and the Service Economy and the Minister for Competition Policy and Consumer Affairs. The report is in part in response to the 2008 inquiry into the franchising sector issued in November 2009.

Franchisors can now breathe - High Court decides Ketchell. The High Court handed down its decision in the Ketchell case on 27 August 2008, overturning the New South Wales Court of Appeal's decision and confirming that a breach of the Franchising Code of Conduct in failing to obtain a legal sign off, does not mean the contract is dead. But the case is not a green light for franchisor's to ignore the Code

With the High Court's Ketchell judgment on the way, should the franchise industry fear Judgement Day? The Australian recently reported that the High Court is currently considering an appeal in the Ketchell case that "could destroy the franchise industry of Australia". That's right, the franchise industry's own Judgement Day could apparently be on the way. Is the situation really that dramatic? Not quite. However, for our franchise industry the High Court's decision will be important and franchisors and franchisees should take notice of what happens.
