Specific Assignments
- Acting in High Court and Appeal Court precedent cases relating to the operation and interpretation of the Retirement Villages Act and accreditation matters for health providers
- Advising in relation to the Therapeutic Goods Act, including the inclusion of goods on the Australian Register of Therapeutic Goods and the advertising, labelling and packaging of therapeutic goods
- Acting for the taxpayers (Hart v Commissioner of Taxation) in this leading test case relating to split loans and a taxpayer’s ability to apply income to non-deductible items
- Advising the Retirement Villages Association NSW and ACT, the Aged and Community Services Association NSW and ACT and the Australian Nursing Homes and Extended Care Association in relation to submissions on the review of the Retirement Villages Act
Arthur holds dual qualifications in accounting and law. His principal areas of practice are in the areas of health and aged care, particularly in relation to retirement villages and nursing homes, as well as property and construction related litigation.
His health and aged care expertise includes advising industry associations and assisting them in making submissions to government about changes to legislation relevant to aged care and retirement villages.
Arthur also has extensive experience in advising retirement village and nursing home operators in relation to the Aged Care Act and the Retirement Villages Act, and advising in relation to resident contracts, accommodation bond agreements, disclosure documents and budget disputes.
He has conducted hearings in all major superior courts and in principal domestic tribunals. His matters have been exclusively contractual and commercial in nature.
Arthur has also had extensive experience in equitable principles and administrative law with significant experience in tax-related disputes and related matters.
